The City has followed through with the settlement measure that was discussed at our September 18 2018 meeting with them. They have agreed to show the greenspace linkages, established in OPA 76 as a result of an earlier settlement of a GA appeal, in a new non-binding Annex 16 to the Official Plan. This satisfies our settlement proposal and we now await formal documentation and approval.

Settlement of GA appeal of OPA 150, Planning Committee March 28
The settlement agreement for the GA’s appeal of OPA 150 was approved by Planning Committee. Only council approval is now required, expected on April 11. With this settlement, and the approval and settlement described in item 3d below, no Natural Systems issues remain under appeal and a hearing will not be required. (P.S. It was subsequently determined that everything would be dealt with in a teleconference with LPAT on June 11.) The urban expansion issues remain under appeal. A preconference hearing is scheduled for May 22 to deal with these and any other outstanding issues. We agreed to explore the opportunity of filing a motion to dismiss the urban expansion appeal at this prehearing.

However, a response motion filed by the appellants led us to conclude that there was no prospect for our motion to be successful. We therefore sought, and obtained, the appellants’ agreement to withdraw the motion prior the prehearing on May 22.]

OPA150/180 Appeals
The last remaining set of appeals of OPA 150/180, dealing with Urban Expansion, were to be heard over a two week period starting on August 12. We are a recognized party in this appeal process. We retained the services of an expert witness and he prepared a first draft of his witness statement. However, the appellants requested that the hearings be suspended pending the outcome of the new Official Plan process that has now been launched. This was in effect the rationale in the motion for dismissal that we served, then withdrew, earlier on. So we can stand down for a while as the target date for approval of the new OP is the first quarter of 2021.
