The pre-hearing conference of May 22 was over within the hour.  The main business was the City’s motion to settle all appeals related to “Building Heights and Design.”  This was presented to Planning Committee on April 11, 2019 (item 8) and endorsed by City Council on April 24 (item 20).  The City could now announce that the last appellant (Bridgeport) had withdrawn its appeal and that settlement had been reached with all others.  An Affidavit by Bruce Finlay (4 MB) was provided.  The first nine pages of the Affidavit summarize matters.  Specifics are found in Exhibit 5 (pages 43-52 of the PDF).  The City also requested that all appeals against certain OPA 150 changes be dismissed (Exhibit 7, pages 64-77).

Counsel for appellants confirmed and agreed.  The Member, recently appointed (formerly an environmental lawyer), Ms. Paula Boutis, agreed on the spot.
